Terms and Conditions


  1. By registering for Express Stop Points Loyalty Program and using the Express Stop Points “ESP” Application “App”, the participant agrees to be bound by the ESP Terms and Conditions, which are listed below.
  2. An ESP participant must complete certain ESP registration information to be eligible for sweepstakes, as well as to utilize other ESP program benefits such as  “Alternative Identification”.  Alternative Identification offers you the opportunity to use your phone number as a source of identification.
  3. Points may be earned at participating Express Stop locations and premises of Express Stop Partners for qualifying purchases (as specified by Express Stop using approved payment means.)
  4. Points will not be accumulated for the following purchases: Lotto, Lottery Tickets, Bottle Deposits, Prepaid Cards, or third-party services.
  5. Participants must provide a valid “ESP” Membership Card, or an App generated Member Bar Code or use a properly configured alternative ID to earn points. These must be presented at the time of purchase. Points will not be awarded for any previous purchases not captured at the time of the original sale.
  6. Only one ESP Membership per customer. Points may not be combined or transferred between participants.  Points may only be claimed for transactions that the ESP Member is making.  Under no circumstance may anyone claim points that someone else has paid for.
  7. ESP coupons may be redeemed at any participating Express Stop location, unless otherwise specified.
  8. Express Stop “ES” may substitute any rewards or prizes for those of a comparable value without notice.
  9. Express Stop shall not be responsible for any programing of phone issues that might unintentionally be caused by the Express Stop Points App.
  10. Express Stop shall not be responsible for any errors resulting from computer hardware or software errors or fraud.
  11. All Express Stop Points Cards and the Express Stop App are licensed to Express Stop. Card or App ownership does not transfer to the participant. Express Stop may cancel any ESP Card or App Membership at any time in its sole discretion.
  12. Express Stop may amend the ESP participant Terms and Conditions or any specific ESP promotion at any time. It is the participant’s obligation to keep informed of the latest ESP Terms and Conditions.
  13. Express Stop reserves the right to terminate the ESP program at any, or all, participating locations at any time without prior notice.
  14. Employees of Express Stop or any affiliates shall not be eligible for any prize-oriented sweepstakes or giveaways.
  15. Copyright Protection and Use of Express Stop Information. The Express Stop Points program is protected by copyright as a collective work and/or compilation, pursuant to U.S. copyright laws, international conventions and other copyright laws. Company names, logos and trademarks may not be used by you in any manner without the prior written consent of Express Stop.
  16. Indemnification for Participant Breach of Agreement. Participant hereby agrees to indemnify, defend and hold Express Stop, and all its officers, directors, owners, agents, employees, information providers, licensors and licensees (collectively, the “Indemnified Parties”) harmless from and against any and all liabilities and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach by participant of the Agreement or the foregoing representations, warranties and covenants, including, without limitation, attorney’s fees and costs. You shall cooperate as fully as reasonably required in the defense of any claim. Express Stop reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by participant and participant shall not in any event settle any matter without the written consent of Express Stop.
  17. No warranty. The ESP program, including all content, software, functions, materials and information made available to you or accessed by you, is provided “AS IS.” to the fullest extent permissible by law, ES makes no representation or warranties of any kind whatsoever for the content of the ESP program or the materials, information and functions made accessible. Further, ES disclaims any express or implied warranties, including, without limitation, non-infringement, merchantability or fitness for a particular purpose. ES assumes no responsibility and shall not be liable for any damages by use of the ESP program. Company and its subsidiaries and affiliates shall not be liable for the use of the ESP, including, without limitation, the content and any errors contained therein. Express Stop shall not be liable for any failure of the ESP program which results from acts or events beyond the Company’s reasonable control.
  18. No award of damages against ES. In no event shall ES be liable for any direct, indirect, special, consequential or other damages arising out of the use of the ESP program. This includes without limitation lost profits, business interruption, damage to equipment, computer programs, or information system, or the loss of any information or data. The maximum liability collectively of ES shall not exceed ten ($10) for any damages of any nature, including gross negligence, arising in contract, tort or otherwise.
  19. Entire agreement. These Terms and Conditions and the Privacy Statement constitute the entire agreement between ES and participant with respect to participants’ use of the ESP program. Any cause of action participant may have with respect to participants use of the ESP program must be commenced within one (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of the agreement, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the agreement, and the remainder of this agreement shall continue in full force and effect.
  20. Privacy statement. Express Stop is committed to providing its customers with the highest level of customer care by continuously improving our services, quality products and image. The information gathered by our ESP program will be used in furtherance of that mission. We will not release your name to any list service or manufacturer, and this information will be held in the strictest of confidence.
